KNDD- FM LAND THE GIG Contest Rules

Who Can Enter
1. To enter, contestants must be legal US citizens or residents and residents of Washington State at least 21 years of age or older as of March 13, 2008. Station reserves the right to examine identification and may reasonably choose to accept or deny awarding the prize based on the identification presented.
2. Employees (including, without limitation, part-time or temporary employees) of Entercom Seattle, LLC d/b/a KNDD-FM (“Station”), Virgin America, other contest sponsors and their respective parent entities, subsidiaries, affiliated companies and advertising and promotion agencies (collectively with Station, “Sponsors”) at any time during the applicable contesting period and of any other Seattle area radio stations (defined as any radio station with its main studios located within a diameter of fifty (50) miles from the downtown Seattle main post office), and the immediate family and other household members (i.e., spouses, parents, grandparents, children, grandchildren, roommates, housemates, significant others, partners and siblings) of each of the above are NOT eligible to enter and/or to win this Contest.
How to Enter
3. No purchase is necessary to enter or win.
4. There is one way to enter each of two different contests that make up this Contest:
a. Performance Contest: Beginning on March 18, 2008 at 10:00am and ending on March 26, 2008 at 5:30PM (PST), 1077 The End listeners can log onto www.1077theend.com, then click on “Land The Gig” link on the contest page, you will then be directed to the official entry form. Only official entry forms will be accepted. You will need to complete the entry form with your band name, the names of your band members, city, zip code and dates of birth as submit it in one of the following ways, together with a song or rap described in detail in Section #5 below:
i. Print the entry form, complete it by hand or typed and mail or overnight it (with your song in cassette or CD format only) to: Land the Gig, KNDD, 1100 Olive Way, Suite 1650, Seattle, Washington 98101. All mailed or overnighted entries must be received by the Station no later than 5:30pm on March 28, 2008 in order to be eligible. The entry form and CD/cassette must both be in one sealed envelope clearly labeled “Land The Gig Contest”. Only one song per entry and only one entry per envelope.
ii. Print the entry form, complete it by hand or typed and deliver it in person (with your song in CD or cassette form only) to KNDD, 1100 Olive Way, Suite 1650, Seattle, Washington 98101. All hand delivered entries must be received by the Station no later than 5:30pm on March 28, 2008 in order to be eligible and will only be accepted during regular Station business hours of Monday-Friday 8:30am-5:30pm . The entry form and CD/cassette must both be in one sealed envelope clearly labeled “Land The Gig Contest”. Only one song per entry and only one entry per envelope.
iii. Download the entry form, complete it by computer or by hand as a PDF and email the completed entry form (with your song in MP3 format only) to endcontests@1077theend.com. All emailed entries must be received by Station by 5:30pm on March 28, 2008 in order to be eligible. Only one song per entry and only on entry per email.
b. Voter Contest: Any eligible visitor to www.1077theend.com may vote in each round of the “Land the Gig” contest as described below in Section 23. All voters will be automatically entered into a random drawing as described below in Section 19.
5. The CD, MP3 or cassettes must include a song or rap of no more than Five (5) minutes in duration, sung and performed by all of the entrants named on the entry form. Songs must be originally written music and fully performed by the entrants. No sampling or recorded music may be included unless the music was created and written by one or more of the entrants and musical performances actually performed by one or more of the entrants. The CD/cassettes and MP3’s MUST NOT contain any copyrighted music or other material -- entries containing any copyrighted music performances will be automatically disqualified unless all of the writers and performers of that music are among the entrants. In the event that any CD/cassettes and MP3’s submitted that exceeds 5 minutes, Station judges will only consider the first 5 minutes in this contest. BY ENTERING THIS CONTEST, THE ENTRANT IS REPRESENTING TO STATION THAT THE USE AND DISTRIBUTION OF SUCH AUDIO WILL NOT VIOLATE OR INFRINGE UPON THE RIGHTS OF ANY THIRD PARTY, INCLUDING, WITHOUT LIMITATION, COPYRIGHTS OF OTHERS. By submitting audio, Entrants agree to indemnify Station should any representations and warranties in these contest rules prove to be false or inaccurate.
6. Entries must not contain any indecency, profanity or obscenity as determined by Station in its sole discretion. KEEP IT CLEAN.
7. Failure to properly address the envelope or failure to secure both your entry and CD or cassette in a sealed envelope or failure to email your MP3 and entry form all in one email may result in disqualification in this contest, in Station’s sole discretion. Sponsors are not responsible for lost, msidelivered, delayed, misplaced entries or improperly sealed entries in which the entry cassette and/or CD is separated from the entry form. Entries must be legible and contain all information required.
8. WHETHER OR NOT SELECTED AS A WINNER OR FINALIST, ALL ENTRIES BECOME THE SOLE PROPERTY OF STATION AND MAY BE USED BY STATION IN ANY MEDIUM IT DEEMS DESIRABLE NOW OR IN THE FUTURE WITHOUT ANY COMPENSATION TO THE ENTRANT, HIS/HER PARTNER OR ANY OF THE PERSONS WHO APPEAR IN OR PROVIDE MATERIALS FOR THE SUBMISSION.
9. By entering in this Contest, Entrants acknowledge and agree that they will comply with all local, state and/or federal laws or other associated rules and regulations associated that may be applicable.
10. By entering this contest, entrants acknowledge and agree that Station reserves the right to post some or all of the entries on the Station’s website.
11. Each entry can be made by a solo artist or a group of no more than ten people. All performers shall be deemed entrants in this contest and must satisfy and comply with the entry requirements set forth in these contest rules in order to participate.
12. Only one entry per person or band will be accepted. Any entry which includes the one or more of the same people as another entry will result in the disqualification of all but one of such entries -- and the decision of the Station as to which to include will be in the Station’s sole and absolute direction and is not subject to appeal.
13. By entering this Contest, Entrants represent warrant and covenant that they have obtained permission from all performers consenting to submission of the Entry, participation in the Contest and agreement to the terms of these official Contest rules.
14. By entering this Contest, Entrants represent, warrant and covenant that (i) except for music performance licenses available to the Station from ASCAP, BMI and SESAC (which does NOT include use of another party’s performance (i.e. karaoke style), (ii) the content of Entry will not violate or infringe any rights of third parties; and (iii) Entrants have the right and authority to grant the to the Station rights to the content provided in the Entry. By entering this Contest, Entrants agrees to indemnify, defend and hold Station harmless from and against any claims, expenses proceedings, suits, actions or costs (including costs from reasonable attorneys’ fees) of any kind or nature incurred by Station on account of a breach by Entrant of any of their representations, warranties, covenants or agreements as a result of Entrant’s participation in the Contest.
15. Station retains sole and exclusive possession and retains all rights to use any Entry, or any part thereof, including but not limited to the musical performance submitted with an Entry, indefinitely in any advertising, promotion or use of any other kind including, but not limited, to on-air usage without any compensation to Entrants or any third parties. The aforementioned stipulations apply to all winning and non-winning Entries. Station is not responsible for any costs associated with submitting any Entry or any costs arising out of participating in the Contest or failure to adhere to official Contest rules.
16. All entries become the property of the Station and will not be acknowledged or returned. Entries received that are mutilated, tampered with, illegible, or from ineligible entrants will be void. Entries that are determined to be fraudulent will be void, and the person making such an entry barred from further participation in that contest. Incomplete entries may be disqualified in Station’s sole discretion.
17. Sponsors are not responsible for any technical difficulties experienced due to overload, busy signals, loss of phone service, electronic problems or any other factor that may prevent an individual from completing a phone call, receiving or sending an email, accessing the Station website, or for any technical malfunction related to any telephone connection, servers, routers, or any other technical problem that may impact entry, participation or prize claim. Sponsors will not be responsible for any printing errors.
HOW TO WIN
18. PERFORMANCE CONTEST:
a. FIRST ROUND (JUDGING): On or about March 28, 2008, the Station will then select up to ten (10) Entries (each,”Qualifier”) from all timely entries received. Entries will be judged by Station personnel, based on 1) singing ability 2) musical composition 3) overall style (i.e. could this person(s) “Land the Gig”?) and such other lawful criteria as determined in Station’s sole discretion. All judgments will be at the sole discretion of Station personnel and their decisions shall be final and non-appealable.
b. SECOND ROUND (VOTING). The first round will take place between 6:00PM (PST) March 28, 2008 and 11:59:59PM (PST) April 3, 2008. Listeners will be encouraged to log on to www.1077theend.com by clicking on the “Land the Gig” link to listen to and vote for their favorite Qualifier. Listeners may log on to the website and vote as often as they wish. Any votes received after this deadline will not be counted. The top two Qualifiers receiving the most votes will advance to the next round (each, a “Second Round Qualifier”). In the event of a tie the top voted entries will be judged by Station personnel, based on 1) singing ability 2) musical composition 3) overall style and the best of the tied entries (as determined by the Station in its sole discretion based on any lawful criteria) will Land the Gig and become a Second Round Qualifier.
c. THIRD ROUND EVENT. Second Round Qualifiers will be notified by phone Wednesday April 3, 2008 before 5:30pm and will be required to sing live on April 8, 2008 at The Showbox Market & 1426 1st AVE, Seattle, WA, 98101 to have the opportunity to compete for the Grand Prize (“Finalists”). THERE WILL BE NO CHARGE FOR SECOND ROUND QUALIFIERS TO ATTEND THE GROUND PRIZE EVENT AND EACH MEMBER OF A SECOND ROUND QUALIFIER WILL RECEIVE TWO TICKETS FOR THE GRAND PRIZE EVENT. Finalists must perform live and must be present to win. Only the actual entrant and the actual persons named in the initial entry form may perform (irreconcilable break-ups are at your risk). Check-in will begin at 6pm. Any Finalist not checked in by 7pm (PST) will be disqualified. Finalists’ spots are not assignable. And show a valid government photo I.D. and sign a liability release agreement and/or other forms prior to being permitted to compete in the final round. Event will begin at approximately 8pm and continue until all finalists have performed the same song that they performed in their submission (approximately 3 hours). Finalists must remain until the grand prize winner is announced. A panel of judges will judge finalists’ performances in order to determine one (1) Grand Prize winner, subject to verification of eligibility and compliance with these contest rules. Finalists will be judged based upon any lawful criteria that the judges deem desirable.
d. Station will only be required to leave one message on one of the numbers provided by the Qualifiers and Second Round Qualifiers. If no answer, response or answering machine is reached, Station will not be obligated to attempt any further contact. However, Station reserves the right, in its sole discretion, to attempt to contact any entrant more than once and shall not be required to attempt to contact all entrants an equal number of times or in the same manner/mode.
e. If a Second Round Qualifier does not timely register for the Grand Prize event as set forth above for any reason, that selected Second Round Qualifier will not be eligible to participate further in this contest nor eligible to win any prize in this contest and shall not be entitled to any alternative prize or compensation as a result. In such case, the other Second Round Qualifier will automatically be deemed the grand prize winner in this contest (subject to verification of eligibility and compliance with these contest rules).
f. Finalists hereby agree to strictly follow all instructions and directions given by the event staff at the Grand Prize Event and understand that any intentional failure to comply with the processes, procedures and instructions at the Grand Prize Event may result in immediate disqualification, in Station’s sole discretion.
g. Finalist performances must not contain any indecency, profanity or obscenity as determined by Station in its sole discretion.
19. Voting Contest:
a. For First Round Voting, anyone that visits the Land the Gig link at www.1077theend will be allowed to vote on their favorite entry beginning on March 28, 2008 at 6:00AM (PST) and ending April 3, 2008 at 11:59:59 PM (PST). You can vote as many times as you like but each voter will only receive a maximum of one (1) entry into the voting contest.
b. On or about April 4, 2008, Station will randomly select (A) nine (9) runner-up voter winners from among all voter entries timely received to win two (2) tickets to the Grand Prize Event on April 8, 2008 at The Showbox Market & 1426 1st AVE, Seattle, WA, 98101, and (B) one (1) voter entrant to win the “Voter Grand Prize” of two tickets to the Grand Prize Event plus a trip for two to their choice of Los Angeles, CA or San Francisco, CA aboard Virgin America as described below.
Prize(s)
20. The Performance Contest:
a. The recognized winners of the Performance contest (subject to verification of eligibility) will be each of the individual performers whose name was included in the initial entry form.
b. Qualifiers will not win any prize in this contest, unless they are selected as one of the two Second Round Qualifiers.
c. Second Round Qualifiers in the Performance contest will win no prize other than a total of ten (10) tickets per band to the Grand Prize event for themselves and their guests (total value of $1,250) and an opportunity to compete in the Grand Prize Event.
d. One Grand Prize will be awarded to the verified Performance winner(s) in this contest. At the Grand Prize Event, Second Round Qualifier performances will be videotaped. The Grand Prize winning band will have that videotape professionally produced, edited and directed and (A) it will be played on at least one occasion between May 1, 2008 and December 31, 2008 aboard Virgin America flight and (B) the band will receive a total of 5 DVDs of the final music video as well as a web version for internet posting. Total grand prize value of approximately $5,000. The music video will be directed by Jesse Harris and produced by Rainy Day Pictures. The band is not guaranteed any creative input into the music video or final edited cut of the music video. By entering this contest, the grand prize winners understand and agree that Virgin America, Inc. will own all copyrights to the final video.
21. The Voting Contest:
a. Nine runner-up winners will receive two (2) tickets to the Grand Prize Event on April 8, 2008 at The Showbox Market & 1426 1st AVE, Seattle, WA, 98101 (valued at approximately $250).
b. One “voter” grand prize winner will receive two (2) tickets to the Grand Prize Event on April 8, 2008 and a trip for two to their choice of Los Angeles, CA or San Francisco, CA aboard Virgin America as described below. Trip includes coach-class roundtrip airfare for two (2) from Seattle, WA to their choice of Los Angeles, CA or San Francisco, CA aboard Virgin America, 2 nights hotel accommodations (room only, double occupancy - no taxes, gratuities, or incidental expenses included) and $100 in an American Express Gift Card for winner to use toward ground transportation or other expenses. (Total value estimated at $1750). Trip must be booked before December 31, 2008 and is subject to availability and other restrictions (including peak period blackouts) apply. Winner will need to contact hotel in advance to confirm rooms are available. If winner chooses to travel San Francisco they will be staying at the Hotel Vitale. If winner chooses to travel to Los Angeles they will be staying at The Renaissance Hotel. If these hotels in the city of the winner’s choice are not available during the winner’s requested travel dates, Virgin America will book another hotel with the winner’s approval in a similar star rating and accommodations.
22. Ticket winners will be notified by email and be required to pick up their tickets no later than April 8, 2008 at the Station studios during regular business hours. Voting winners who do not pick up their tickets at the Station offices by 5:30pm on April 8, 2008 will not be entitled to any alternate prize in this contest.
23. Notwithstanding anything to the contrary herein or stated on-air, no person will be entitled to receive any prize until after their eligibility has been confirmed or accepted by Station and all required paperwork (including, without limitation, liability release agreements) have been completed by the pending winner within the required deadlines.
24. All prizes awarded must be picked up or verified at the Station’s studios at 1100 Olive Way Suite 1650, Seattle, WA, 98101 during normal business hours of 8:30 a.m. to 5:30p.m. (PST), Monday through Friday. Prizes will not be mailed, unless otherwise determined by the Station.
25. Prizes will be released to winners only. Winners are required to present a valid state photo ID and valid social security number in order to pick up any prize.
26. Winners may required, in Station’s sole discretion, to sign a Liability Release Agreement relieving the Station, its parents, subsidiaries, officers, directors, members, managers, employees, agents and contest sponsors from any and all liability with respect to the contestant’s participation in the contest and the receipt and/or use of the prize. Any person who refuses to sign the Release and/or provide a social security number or complete or provide any other documents required by the Station by the deadline required by Station will forfeit any and all contest prizes.
27. Station reserves the right to substitute a prize of equal or greater value for all contests and giveaways. Non-cash prizes are not redeemable for cash. No transfer or assignment of prizes is allowed.
28. Prizes not claimed within thirty (30) business days of being awarded, or in the case of a time sensitive prize, within its period of usability, shall be considered forfeited and will become property of Station. Such prize may be disposed of at the discretion of Station Management.
29. Winners are responsible for paying all applicable local, county, state and federal taxes on prizes based on the estimated retail value of the prize, as set forth in the contest rules, and will be issued an IRS 1099 form for all prizes won from Station where the aggregate value of all prizes is $600 or more.
30. Sponsors are not responsible for replacing or reimbursing winners with any form of compensation for events or travel plans that are canceled, rescheduled or delayed. All cancellations are deemed beyond the control of Station and its sponsors. This includes, but is not limited to, event cancellations, event and/or flight postponement and delays of any form and duration, as well as all delays or cancellations due to acts of nature, terrorism (including threats), illness or war. Additionally, Station is not responsible for any work stoppage that may affect Station’s ability to provide any of the prizes. Station is not responsible for any expenses incurred by contest winners as a result of such cancellations or delays.
31. Any prize that is awarded in the form of a gift certificate or gift card may have an expiration date and use of such certificate may be based on availability and include black-out periods, restrictions or excluded items (for example, tax, tips, alcoholic beverage, or goods from a particular manufacturer). In all instances in which winner has the right to select specific products, the choice or products offered may be limited by the Sponsor or certain specific products or manufacturers may be excluded. Winner will receive more information on such restrictions and limitations after they have been awarded the prize.
Other Rules
32. Station is not responsible for technical problems that may impact the ability of an Entry to be played once received by Station.
33. Station is not responsible for any technical difficulties experienced due to overload, busy signals, loss of phone service, electronic problems or any other factor that may prevent an individual from completing a phone call or for any technical malfunction related to any telephone connection, servers, routers, or any other technical problem that may impact entry or Prize claim including, without limitation, any internet telephone call connections.
34. Station is not responsible for any technical difficulties that may prevent an individual from casting a vote. Station assumes no responsibility for interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), website, telephone or other connections, availability or accessibility, or miscommunications, or failed computer, satellite, telephone or cable transmissions, or lines, or technical failure or jumbled, garbled, corrupted, scrambled, delayed, or misdirected transmissions, or computer hardware or software or telephone malfunctions, failures, or technical errors or difficulties, or other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture of information or the failure to capture, or loss of, any such information. Station assumes no responsibility for any incorrect or inaccurate information, whether caused by website users, or by any equipment or programming associated with or utilized in this Contest; any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of the website. If, for any reason, Contest, in the sole opinion of Station, is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, hacking, unauthorized intervention, fraud, technical failures or any other causes which, in sole opinion of the Station, corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Station reserves the right, at its sole discretion, to cancel, terminate, modify or suspend Contest.
35. Entries received by Station that are mutilated, tampered with, illegible, from ineligible Entrants, or damaged in any way as determined by Station in its sole discretion will be void. Station is not responsible for lost, late, or misdirected mail. Entries that are determined by Station to be fraudulent will be void and the person making such an entry barred from further participation in the Contest.
36. Station Management shall be the sole arbiters in all matters relating to the contest and in the interpretation of contest rules. Their decisions shall be final. Entry into the contests constitutes agreement by contestants to abide by these rules, as well as any other rules established by Station.
37. By participating in a Station contest, entrants hereby agree that Sponsors have no, and hereby release Sponsors from all known or unknown responsibility or liability in connection with any injuries, losses or damages of any kind caused by or resulting from the acceptance, possession and/or use of a prize or an entrant’s participation in any such contest.
38. By participating in a Station contest, entrants hereby consents to the Station and contest sponsors’ usage of any one or more of the following for on-air broadcast and for any other advertising and promotional purpose without payment of any additional consideration: contestant’s name; voice; likeness; biographical information; his/her participation in the contest; and the substance of the contestant’s performance in connection with this contest.
39. Complete contest rules are available at the Station studios at 1100 Olive Way Suite 1650, Seattle, WA, 98101 during normal business hours of 8:30a.m. to 5:30 p.m. (PST), Monday through Friday or go online at www.1077theend.com.
40. Station contests are subject to all applicable laws and regulations and are void where prohibited.
41. Station reserves the right to: (i) terminate or declare any Contest null and void and rescind any prize, if in its sole judgment, the rules or the integrity of the Contest have been violated or compromised in any way, intentionally or unintentionally by any person whether or not a participant in the Contest; (ii) alter or amend these Contest rules at any time; and (iii) stop or conclude the Contest at any time without prior notice. Material changes to the contest rules will be broadcast on-air, when practical.
42. Winner’s List: For a list of winners mail a self-addressed stamped envelope to the Station address identifying the name of the particular contest that you would like to receive a winner’s list for. The Station address is 1100 Olive Way Suite 1650, Seattle, WA, 98101. All requests for winner lists must be mailed and received by the Station after the contest is over but prior to 4 months after the contest has been concluded. |
